Policy
This Policy sets out how GrowthMog collects, uses, discloses and protects personal information in connection with growthmog.com and the services described on it. It is issued in accordance with PIPEDA and should be read together with the Terms of Use.
1.Scope and Application
1.1
This Privacy Policy (the "Policy") describes the manner in which GrowthMog ("GrowthMog", "we", "us" or "our") collects, uses, discloses, retains and protects Personal Information in connection with the website located at growthmog.com (the "Site") and the marketing services offered through it (the "Services").
1.2
The Policy is issued in accordance with the Personal Information Protection and Electronic Documents Act (Canada) ("PIPEDA") and applicable provincial privacy legislation. Where a client is located outside Canada, we apply the standards set out in this Policy as a minimum, without prejudice to any additional rights that client may hold under the law of its own jurisdiction.
1.3
By accessing the Site, submitting the contact form, or engaging us to perform the Services, you acknowledge that you have read and understood this Policy.
2.Definitions
2.1
"Personal Information" means information about an identifiable individual, as that term is defined in PIPEDA. Business contact information used solely to communicate with an individual in relation to their employment, business or profession is treated in accordance with the exemptions available under applicable law.
2.2
"Client" means a person or entity that has engaged GrowthMog to perform the Services. "Enquirer" means a person who contacts GrowthMog but has not engaged us. "You" means either, as the context requires.
2.3
"Service Provider" means a third party engaged by GrowthMog to perform a function on our behalf, including website hosting, form delivery, electronic mail and telephony.
3.Personal Information Collected
3.1
GrowthMog collects only the Personal Information reasonably required for the purposes identified in Section 4. We do not collect Personal Information by any means other than those described in this Section.
3.2
Information you submit through the contact form. The form on the Site requests your name, the name and location of your shop, your telephone number, your preferred time to be contacted, and any message you elect to provide.
3.3
Information provided by telephone or electronic mail. Any information you communicate to us in the course of an enquiry, an audit, or an engagement.
3.4
Client operating information. Where you are a Client, you report to us a single monthly gross sales figure for the purpose of calculating the performance component of our fee, together with such operational details as are necessary to perform the Services. GrowthMog does not connect to, and does not receive access to, your point of sale system, your accounting records, your banking information, or information concerning your customers.
3.5
Technical information. Our hosting Service Provider records standard server log data, including internet protocol address, request time, requested resource and user agent, as is inherent in the operation of any website.
3.6
GrowthMog does not collect payment card numbers, financial account credentials, government-issued identifiers, health information, or any category of sensitive Personal Information, and requests that you do not transmit such information to us.
4.Purposes of Collection, Use and Disclosure
4.1
Personal Information is collected, used and disclosed for the following purposes only: (a) to respond to an enquiry and arrange the complimentary audit; (b) to establish and administer an engagement for the Services; (c) to perform the Services, including the management of a Client’s business listings, website and marketing assets; (d) to calculate fees, issue invoices and maintain accounting records; (e) to communicate with you regarding work in progress; and (f) to comply with legal, regulatory and tax obligations.
4.2
GrowthMog does not sell, rent, licence or trade Personal Information. GrowthMog does not disclose Personal Information to any third party for that party’s own marketing purposes, and does not conduct mass or unsolicited commercial electronic messaging.
4.3
GrowthMog may disclose Personal Information without consent only where permitted or required by law, including in response to a lawful order of a court or regulatory authority, or where necessary to establish or defend a legal claim.
5.Consent
5.1
By submitting the contact form or otherwise providing Personal Information to us, you consent to its collection, use and disclosure for the purposes set out in Section 4.
5.2
You may withdraw your consent at any time, subject to legal and contractual restrictions and reasonable notice. Withdrawal of consent may prevent us from performing the Services or responding to your enquiry, and we will inform you of the likely consequences before giving effect to the withdrawal.
6.Disclosure to Service Providers
6.1
GrowthMog engages the following categories of Service Provider, each of which receives only the Personal Information required to perform its function: (a) FormSubmit, which transmits contact form submissions to our electronic mail address; (b) Vercel Inc., which hosts the Site and maintains the server logs described in clause 3.5; (c) Google LLC, which delivers the typefaces used on the Site by way of the Google Fonts service, with the result that your browser discloses your internet protocol address to Google when requesting those files; and (d) our electronic mail and telephony providers.
6.2
Where you are a Client, the Services are performed on platforms operated by third parties, principally Google Business Profile and your website host. Those accounts are registered in your name and remain under your control.
6.3
Each Service Provider processes information it receives under its own privacy policy and terms. GrowthMog does not control, and does not accept responsibility for, the independent practices of those parties.
7.Storage and Transfer Outside Canada
7.1
Certain Service Providers identified in Section 6 are located in, or store data in, the United States and other jurisdictions outside Canada.
7.2
Personal Information stored in a foreign jurisdiction is subject to the laws of that jurisdiction and may be accessible to the courts, law enforcement agencies and national security authorities of that jurisdiction. By providing Personal Information to us, you acknowledge this transfer and the consequences described in this Section.
8.Cookies, Analytics and On-Site Features
8.1
The Site sets no cookies, deploys no analytics or measurement software, contains no advertising pixels or tracking tags, and does not construct any profile of visitors. No consent management banner is presented because no consent-requiring technology is in use.
8.2
The Site displays an animated figure describing repair work booked at shops in the visitor’s area. That figure is an illustrative device generated locally in the browser from elapsed time on the page. It does not access location data, does not reflect actual bookings, and is not derived from any information about the visitor.
8.3
The Site does not request access to your device location, camera, microphone, contacts or files.
9.Retention
9.1
Personal Information is retained only as long as necessary for the purposes for which it was collected, or as required by applicable law.
9.2
Enquiry correspondence from persons who do not become Clients is deleted upon request and, in any event, is not used for any purpose other than that for which it was submitted.
9.3
Client records, invoices, reports and related correspondence are retained for the duration of the engagement and thereafter for the period required by applicable tax, accounting and limitation legislation.
10.Safeguards
10.1
GrowthMog maintains physical, organisational and technological safeguards appropriate to the sensitivity of the Personal Information in its custody, including transport layer encryption across the Site, access controls on accounts holding Personal Information, and restriction of access to those persons who require it.
10.2
No method of transmission or storage is entirely secure, and GrowthMog does not warrant absolute security. In the event of a breach of security safeguards creating a real risk of significant harm, GrowthMog will notify affected individuals and the Office of the Privacy Commissioner of Canada as required by law.
11.Access, Correction and Withdrawal
11.1
Subject to the exceptions prescribed by law, you may request confirmation of whether we hold Personal Information about you, access to that information, an account of how it has been used and to whom it has been disclosed, and correction of any inaccuracy.
11.2
Requests should be directed to the contact particulars in Section 15. We will respond within thirty (30) days of receipt, or within such extended period as PIPEDA permits, and will state our reasons if a request is refused in whole or in part. No fee is charged for a routine request.
11.3
You may request deletion of your Personal Information, which we will effect except where retention is required by law or is necessary for the establishment or defence of a legal claim.
12.Third-Party Websites
12.1
The Site may contain links to websites operated by third parties. This Policy does not apply to those websites, and GrowthMog is not responsible for their content or privacy practices.
13.Minors
13.1
The Site and the Services are directed to businesses and are not intended for individuals under the age of eighteen (18). GrowthMog does not knowingly collect Personal Information from minors, and will delete any such information that comes to its attention.
14.Amendment
14.1
GrowthMog may amend this Policy from time to time. The effective date at the head of this Policy indicates when it was last revised. Material amendments affecting the purposes for which Personal Information is used will be brought to the attention of affected Clients.

15.1
Enquiries, access requests and complaints under this Policy may be directed to the individual accountable for GrowthMog’s compliance, Jatin Bagga, at contact@growthmog.com or (905) 783-9701, 8:00 a.m. to 8:00 p.m. Eastern Time, Monday to Saturday.
15.2
If a complaint is not resolved to your satisfaction, you may refer the matter to the Office of the Privacy Commissioner of Canada or, where applicable, to the privacy regulator of your own jurisdiction.
